These Terms of Service ("Terms") govern the use of byforja.com (the "Site") and the services provided by Ether's, trading as Forja ("the Provider", "we", "us").

By using our Site or engaging our services, you agree to these Terms.

3. Pricing and Payment

Quotes: each engagement is subject to a custom quote issued following the consultation. Prices are stated in euros and are exclusive of tax unless otherwise indicated.

Payment: payment terms (schedule, deposit) are specified in the quote. Late payments are subject to penalties in accordance with applicable law.

Consultation: the 30-minute consultation is free of charge and carries no obligation.

4. Performance of Services

Timelines: delivery timelines are indicative and communicated in the quote. The Provider undertakes to use all reasonable efforts to meet the agreed timelines.

Collaboration: successful delivery of services requires the client's active cooperation (providing information, granting access to accounts, approving milestones). Any delay attributable to the client may result in adjusted timelines.

5. Right of Withdrawal

In accordance with the French Consumer Code (and Directive 2011/83/EU for EU consumers), you have a 14-day withdrawal period from acceptance of the quote, without giving any reason and without penalty.

If performance of the services has begun with your express consent before the expiry of the withdrawal period, you acknowledge that you waive your right of withdrawal for services already performed, in accordance with Article L221-28 of the French Consumer Code.

The Provider is bound by an obligation of means, not of result. We commit to deploying the best tools and methods available, but outcomes depend on external factors (market conditions, client engagement, platform algorithms).

Both parties agree to treat as confidential all information exchanged in the course of the engagement. This obligation continues for 2 years after the end of the business relationship.

In the event of a material breach by either party, the other party may terminate the agreement by registered letter with acknowledgement of receipt, following a formal notice that has remained without effect for 15 days.

Services already performed remain payable.

12. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France.

For EU consumers: nothing in these Terms affects your statutory rights under the consumer protection laws of your country of residence.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The applicable Terms are those in force at the date of the order.
